are owned by Polycivic or its licensors and protected by intellectual property laws.

8. Election Forecasts and Political Content Disclaimer

Election forecasts, ratings, analyses, fact-checks, statistical models, projections, and commentary are provided for informational and educational purposes only.

Forecasts are estimates based on available information and methodologies and are not guarantees of future events or election outcomes.

Reasonable people may disagree with interpretations, analyses, or conclusions presented on the Services.

Users should independently evaluate information before relying upon it.

9. No Professional Advice

Content provided through the Services does not constitute legal, financial, investment, tax, professional, or governmental advice.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLYCIVIC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLYCIVIC, ITS OFFICERS, DIRECTORS, VOLUNTEERS, EMPLOYEES, CONTRIBUTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

16. Indemnification

You agree to defend, indemnify, and hold harmless Polycivic and its officers, directors, volunteers, employees, contributors, and affiliates from claims, liabilities, damages, losses, and expenses arising from:

  • Your use of the Services;
  • Your User Content;
  • Your violation of these Terms;
  • Your violation of applicable law.

17. Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA).

Arbitration shall take place in Santa Clara County, California.

The parties waive any right to a jury trial.

The parties further agree that disputes shall be brought only on an individual basis and not as part of a class action, representative action, or consolidated proceeding.

Nothing in this section prevents either party from seeking temporary injunctive relief in a court of competent jurisdiction.

18. Governing Law

These Terms shall be governed by and construed under the laws of the State of California, without regard to conflict-of-law principles.

19. Changes to These Terms

We may modify these Terms from time to time.

Updated versions will be posted on this page with a revised effective date.

Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

20. Termination
